Competition Commission welcomes ConCourt’s dismissal of Takata application to review competition ruling

The Competition Commission has welcomed the Constitutional Court (ConCourt) order, handed down in December 2025, in which it dismissed, with costs, automotive parts company Takata South Africa’s application for leave to appeal an earlier Competition Appeal Court (CAC) ruling.

Takata South Africa had approached the ConCourt requesting leave to appeal a CAC ruling handed down on January 16, 2025, which dismissed, with costs, its appeal and review against the decision of the Competition Tribunal.

In June 2018, the commission referred Takata Corporation and its erstwhile South African subsidiary Takata South Africa to the tribunal for prosecution on 21 instances of alleged collusive conduct, including price fixing, market division and collusive tendering.

Takata subsequently excepted to all 21 referrals on the grounds that each referral failed to disclose a cause of action. The tribunal dismissed the exceptions, which triggered a series of unsuccessful appeals up to the ConCourt.

The commission expects the case against Takata South Africa to be heard on merits by the tribunal in due course.
